Stop Debt Collectors - Are Debt Collectors Harrassing You? Know Your Rights!

How to Stop Debt Collectors And Harassment

1. Write a letter to your debt collectors asking them to cease and desist from contacting you regarding payment. This legal maneuver is provided in the Fair Debt Collection Practices Act which states that collection agencies are obliged to stop asking for payment after you have written them to do so.

2. When it becomes inevitable that you will be lagging behind in your debt payments, or will be unable to cover the minimum monthly due, you must immediately contact your creditor to negotiate a reasonable repayment plan.

Dealing directly with your creditor and not waiting for it to award your debt collection account to third-party commercial debt collectors is a smart strategy that will spare you a lot of problems in the future.

3. When you continue to get a flood of calls from aggressive debt collectors even after you have sent them a cease-and-desist letter, block their phone numbers to stop them from pestering you.

4. Instead of ignoring the calls, answer them and ask the debt collector to stop contacting you by phone and mailing you instead. Not all collectors will oblige, but it's worth trying to see who might comply.

5. Lodge a complaint with the Federal Trade Commission if the contacting procedures being employed by your debt collector do not follow the rules outlined under the Fair Debt collection Practices Act.

To do this, you have to learn the extent of your rights under the law. You will discover, for example, that you can stop debt collectors if they keep calling you beyond the normal business hours of between 8:00 a.m. and 9:00 p.m.

You can also cite them for a violation if they involve your friends, neighbors, and officemates in their debt collection efforts or, worse, reveal to them that they are collecting debt from you.

Invading your privacy with malicious intent to put you in ridicule are grounds to take abusive debt collectors to court and stop them from harassing your for good.

6. If all else fails, you can declare bankruptcy. This final option can be resorted to when your debt is way beyond your capacity to pay or work out a manageable payment arrangement.

As soon as you file for bankruptcy, the court will grant you an automatic stay which will legally stop debt collectors from contacting you for payment or initiating any action to be able to collect your debt.

7. Keep a record of all the documents that you have sent to and received from debt collection agencies. Also log in the dates and times of phone calls they have made. They will help you prove violations of the Fair Debt Practices Act when you can no longer tolerate the repeated disregard of your rights.
